Los Angeles Immigration Lawyers Notify Clients About Work Permits Being Extended for El Salvador TPS Beneficiaries

Work Permits (Employment Authorization Document / EAD) Validity Extended for TPS El Salvador Beneficiaries

USCIS is automatically extending the validity of certain EADs issued under Temporary Protected Status (TPS) for El Salvador for an additional 6 months. On July 8, 2016, DHS announced the extension of the designation of El Salvador for TPS for a period of 18 months. With that extension, DHS also automatically extended the validity of EADs issued under TPS El Salvador for 6 months, through March 9, 2017. To avoid gaps in work authorization, USCIS is now automatically extending the validity of those EADs for an additional 6 months, through September 9, 2017.

If you currently have an EAD that was issued under the TPS designation for El Salvador and has a September 9, 2016 expiration date printed on the front of the card, your EAD will now expire on September 9, 2017. To prove that you are authorized to continue working legally, you may show the following documentation to your employer and government agencies:

  • Your TPS-related EAD; and
  • A copy of today’s Federal Register notice announcing this automatic extension.

Pregnancy and Childbirth Should Not Be Used Against Women In Work Injury Claims

Women injured at work have many unique issues related to their disability and apportionment related matters.  All workers’ compensation attorneys and their client should be aware and cautious how doctors and other professionals address these issues.  Congratulations to Assemblywoman Lorena Gonzalez Fletcher for introducing Assembly Bill 570 which aims to prevent pregnancy, childbirth – or conditions related to pregnancy or childbirth – from being used against workers when addressing apportionment and the cause of disability in a workers’ compensation claim.

AB 570, as introduced, Gonzalez Fletcher. Workers’ compensation: permanent disability apportionment.

Existing workers’ compensation law generally requires employers to secure payment of workers’ compensation, including medical treatment, for injuries incurred by their employees that arise out of, or in the course of, employment. An employer is liable only for the percentage of the permanent disability directly caused by the injury arising out of, and occurring in the course of, employment.

Existing law requires apportionment of permanent disability to be based on causation, and a physician who prepares a report addressing the issue of permanent disability due to a claimed industrial injury is required to address the issue of causation of the permanent disability. Existing law requires the physician to make an apportionment determination by finding the approximate percentage of the permanent disability that was caused by the direct result of injury arising out of and occurring in the course of employment, and the approximate percentage of the permanent disability that was caused by other factors both before and subsequent to the industrial injury, including prior industrial injuries.

This bill would prohibit apportionment, in the case of a physical injury occurring on or after January 1, 2018, from being based on pregnancy, childbirth, or other medical conditions related to pregnancy or childbirth.

USCIS Is Reissuing Receipt Notices to Certain Work Permit (EAD) Renewal Applicants

Starting February 16, 2017, USCIS began reissuing receipt notices (Form I-797) to individuals who applied to renew their Employment Authorization Document (EAD) between July 21, 2016 and January 16, 2017, and whose applications remain pending in the following categories:

  • (a)(3) Refugee
  • (a)(5) Asylee
  • (a)(7) N-8 or N-9
  • (a)(8) Citizen of Micronesia, Marshall Islands, or Palau
  • (a)(10) Withholding of deportation or removal granted
  • (c)(8) Asylum application pending
  • (c)(9) Pending adjustment of status under section 245 of the Immigration and Nationality Act
  • (c)(10) Suspension of deportation applicants (filed before April 1, 1997), cancellation of removal applicants, and special rule cancellation of removal applicants under NACARA
  • (c)(16) Creation of record (Adjustment based on continuous residence since January 1, 1972)
  • (c)(20) Section 210 Legalization (pending Form I-700)
  • (c)(22) Section 245A Legalization (pending Form I-687)
  • (c)(24) LIFE Legalization
  • (c)(31) VAWA self-petitioners

On January 17, 2017, USCIS began automatically extending expiring EADs for up to 180 days for renewal applicants in these categories. However, some of the receipt notices that USCIS sent out before that date did not contain the applicant’s EAD eligibility category. Therefore, the reissued receipt notices will contain:

  • The applicant’s EAD eligibility category;
  • The receipt date, which is the date USCIS received the EAD renewal application and which employers must use to determine whether the automatic EAD extension applies;
  • The notice date, which is the date USCIS reissued the receipt notice; and
  • New information about the 180-day EAD extension.

Applicants may present the reissued receipt notice with their expired EAD to their employer as a List A document for the Form I-9, Employment Eligibility Verification, to show that they are authorized for employment.

Applicants with an EAD based on Temporary Protected Status (TPS) who filed their EAD renewal applications before January 17, 2017, already received a 6-month extension through the Federal Register notice that extended their country’s TPS designation. Therefore, these applicants will not receive a reissued receipt notice. Please visit the Temporary Protected Status page for current information on each TPS designation. All renewal applicants who file Form I-765 applications on or after January 17, 2017, including TPS renewal applicants, will be receiving Form I-797 receipt notices that contain eligibility category information and information about the 180-day EAD extension.
